Restaurant Partner Terms

These Restaurant Partner Terms apply when you claim, manage, pay for, advertise, or use Hungry8 on behalf of a restaurant, food truck, bar, cafe, brand, company, franchise, or other business. They supplement the Hungry8 Terms of Service. If there is a conflict, these Restaurant Partner Terms control for business and restaurant-owner features.

If you use Hungry8 for a business, you confirm that you are authorized to act for that business and to bind it to these terms.

1. Claims and Verification

Hungry8 may allow businesses to claim listings and access owner tools. We may require business email verification, phone verification, documents, payment records, manual review, public listing checks, or other proof of authority. Submitting a claim does not guarantee approval.

We may approve, reject, suspend, revoke, transfer, or re-review claims to protect users, businesses, and platform integrity. You must keep business information accurate and promptly tell us if your authority changes.

2. Listing Information

You are responsible for information you submit or approve, including names, addresses, hours, menus, photos, links, descriptions, offers, dietary claims, ordering links, and contact details. You must have rights to use the content you upload and must not submit misleading, infringing, unsafe, illegal, or deceptive information.

Dietary, allergen, ingredient, nutrition, and food safety claims must be accurate and verifiable. Hungry8 is not responsible for your food preparation, ingredient handling, menu accuracy, pricing, service, or customer experience.

3. Plans, Subscriptions, and Billing

Hungry8 restaurant plans are Free, Starter at $49 per month, Local Group at $69 per month, Growth at $149 per month, and Pro at $299 per month. Plans are all-inclusive. The only Hungry8 charge beyond the plan is $25 per month for each extra location. Hungry8 charges no other fees. A restaurant with 3 locations pays the plan price plus $25 per month for each of the other two locations. Card processing is Stripe's standard fee, not a Hungry8 charge. Prices, billing periods, and taxes are shown at checkout, on invoices, or in the portal.

Unless stated otherwise at purchase, subscriptions renew automatically until canceled. You authorize us to charge your payment method for the plan price, $25 per month for each extra location when it applies, and taxes.

4. Cancellation, Refunds, and Plan Changes

You may cancel future subscription renewals through the available billing flow or by contacting support. Cancellation generally stops future renewal charges but does not automatically refund past charges or a partially used billing period.

If you upgrade, downgrade, cancel, fail payment, or lose claim access, some features may change or stop. Hungry8 may change plan features or prices with notice where required.

5. Partner Points and Rewards

Hungry8 Points that a customer can redeem are funded by the restaurant's partner points pool. Hungry8 deducts restaurant points only when a visit is verified by scanning the restaurant's QR code. Every Hungry8 Point, including points already in a wallet, is redeemed only when the restaurant's QR code is scanned. Reviews, photos, and referrals do not deduct restaurant points. Partner points are promotional credits. They are not bank deposits, cash, stored value, gift cards, or refundable balances.

Unused partner points may expire, be limited by plan rules, or become unavailable if your plan ends, your account is suspended, payment fails, or the rewards program is discontinued. You may not condition user rewards on positive reviews or any required review sentiment. See the Rewards Policy for more detail.

6. Reviews and Customer Communications

You may not create fake reviews, buy positive or negative reviews, suppress honest negative reviews through threats or intimidation, impersonate customers, or use Hungry8 to mislead users. Any request for reviews must allow honest feedback and must not require a particular rating or sentiment.

If Hungry8 provides email, SMS, CRM, or automation tools, you are responsible for using them lawfully, including consent, opt-out, message content, frequency, and industry-specific compliance. We may restrict messaging features that create legal, deliverability, reputation, or user-trust risk.

7. Visibility

A paid plan includes the tools for that plan and may improve visibility. Hungry8 does not guarantee a specific number of views, visits, customers, orders, reviews, followers, revenue, or return on investment.

8. Third-Party Services

Restaurant tools may rely on third-party services such as Stripe, CRM tools, SMS/email providers, hosting providers, analytics, maps, ordering links, social platforms, gift card providers, and restaurant data providers. Third-party services may have their own terms, availability limits, and compliance requirements. Card processing is Stripe's standard fee, not a Hungry8 charge.

9. Access, Teams, and Security

You are responsible for team members, account access, permissions, passwords, devices, and activity under your restaurant account. Only invite authorized people. Tell us promptly if someone leaves your business or accesses your account without permission.

10. Suspension and Termination

We may suspend, restrict, or terminate restaurant features, claims, listings, subscriptions, campaigns, points, or access if we believe there is fraud, payment failure, misuse, legal risk, inaccurate ownership, unsafe content, user harm, violation of terms, or platform abuse.

11. Data and Analytics

Restaurant analytics are estimates based on available signals and may be incomplete, delayed, sampled, or affected by privacy settings, technical limits, user behavior, and third-party systems. Do not treat analytics as audited financial, tax, legal, or accounting records.

12. Indemnity

You agree to defend, indemnify, and hold harmless Hungry8, Whistling in the Dark Ventures LLC DBA Hungry8, and their owners, employees, contractors, service providers, and partners from claims arising from your restaurant, listings, claims, content, offers, food, services, customer communications, rewards, legal compliance, payment obligations, or violation of these terms.
